These general terms and conditions describe the obligations of those persons who participate in the Society’s activities or visit the Society’s website.

The German Society of Montreal and its charitable arm, the Relief and Welfare Fund of the German Society (together, the “German Society” or “we”), organize events for the German community in Montréal and surrounding areas, open to Germans, people of German descent, and all friends of Germany. We communicate information regarding such events, both past and future, as well as other news and other events that may be of interest to the community we serve, which communication is done in various ways such as through emails, social media posts, direct messaging, and publishing information on our website. We refer to such activities, collectively and individually, as the “Activities”.

By using this Website, by allowing us to communicate with you regarding the Activities, and by participating in our Activities, you agree to the Terms set out in these Terms and Conditions, including with regard to your browsing, signing up to Activities, making donations, joining our membership, and any other interactions with the Website. We refer to our Privacy Policy for the terms governing our collection, use, storage, and disclosure of any Personal Data collected.

Definitions

For the purposes of these Terms and Conditions:

  • Terms refer to the binding Terms and Conditions outlined on this page for your use of our Website, including any amendments or updates as well as your participation in our Activities;
  • German Society means the German Society of Montreal and its charitable arm, the Relief and Welfare Fund of the German Society and is also referred to as “we”, “our”, or “us” in this Privacy Policy; 
  • Website refers to the website of the Society, accessible from https://germansociety.ca or https://deutschegesellschaft.ca or https://societeallemande.ca;
  • Activities of the Society means any activities of the German Society including events organized, hosted, or co-hosted by the German Society, events that the German Society is invited to or has invited the German community to, communications regarding such events, regarding other news and events that may be of interest to the community we serve; 

Governing law

These Terms are governed by and construed in accordance with the laws applicable in the Province of Québec, Canada.

Purpose of the Website

Our Website is designed to provide information about the German Society including our Activities, as well as other events and news that we deem might of interest to you. We also offer an e-commerce component for purchasing tickets to events, as well as registering your membership and accepting donations made to the German Society (whether to the German Society or its charitable arm, the Relief and Welfare Fund of the German Society). 

Purchase of tickets

The German Society offers information regarding its Activities and ways to participate, including the registration to Activities and the purchase of tickets to Activities, such as the Ball. It is also possible to make donations via our Website (for more details, we refer to the section below “Donations to the German Society”). 

All transactions, purchases, and donations are subject to these Terms, as well as any specific terms and conditions we may set for a particular Activity, and the terms and conditions provided by the payment processor “Zeffy” at the point of sale, or such other payment processor that the German Society may use, in its sole discretion. 

Tickets for our Activities as well as donations are generally non-refundable and non-cancellable. In exceptional circumstances, we may review the situation and, in our discretion, offer a full or partial reimbursement upon a request made to such end by the buyer. Please contact us if you would like to request such a review. Our decision will take into consideration factors such as timing, reason, and any expenses incurred by the Society at such time.

Participation in Activities implies:

  • consent for photographs and videos to be taken at the event in question and for said photographs to be used by the German Society for advertising, promotional, or other materials, including on its Website, in its newsletters, on its social media platforms, and in any other manner;
  • agreement to act responsibly and respectfully at the event towards guests and staff. We reserve the right to remove any individuals from the venue at the discretion of the German Society or venue staff;
  • agreement not to bring prohibited items to the venue. We reserve the right to restrict access to any persons found to have brought prohibited items with them or to confiscate said items for the duration of the event. Prohibited items include, but are not limited to:erem:
    • alle Gegenstände, die in Montréal, Québec oder Kanada illegal sind;
    • Waffen und andere gefährliche oder tödliche Materialien oder Gegenstände;
    • eigene Speisen oder Getränke (wenn diese von den Veranstaltern bereitgestellt werden);
    • Freizeitdrogen;
    • Gegenstände, die helle oder blinkende Lichter oder laute Geräusche erzeugen oder auf andere Weise störend sind;

We reserve the right to cancel purchased tickets for an event at our discretion for any reason. In the case of a cancellation from our side without justification or serious reason, we will provide a notice to you and a refund. We will not be responsible for any other amount or claim relating to such cancellation.  

Donations to the German Society

The German Society is a non-profit organization and its charitable arm, the Relief and Welfare Fund of the German Society is a registered charity and is governed by laws applicable to such types of organizations.

Donations to the German Society, more specifically to its charitable arm, the Relief and Welfare Fund of the German Society are eligible for a charitable donation tax receipt if they meet the legal requirements applicable to them.

If you wish to make a donation in kind, please contact us to discuss the donation process. In some cases, a certification of value may be required. A charitable donation tax receipt is available for certain types of donations, and will be issued in such a case for the eligible amount according to the applicable legal rules. 

We appreciate any form of generosity towards the German Society and the causes we support. However, in some circumstances, we may decline a donation for various reasons. We can do so at our discretion. 

Acceptance of a donation does not imply endorsement or agreement with the donor’s views, actions, or other affiliations, nor does it entitle the donor to special status, perks, or privileges within the German Society or for its events unless expressly provided for by us.

Age restrictions

Our Activities are addressed to adults. Participants may bring their children to certain events, always under their supervision and guardianship. We do not market our Activities nor transact with children. 

Collection of Personal Data

Our Privacy Policy provides detailed information on how we collect, store, disclose, and use your personal data, including our use of tracking technologies. Our Privacy Policy can be consulted on our Website at https://deutschegesellschaft.ca/en/privacy

User conduct

There are no specific rules or guidelines for using our Website beyond those outlined in these Terms. Users agree to use the Website in a lawful and responsible manner, in accordance with all applicable laws and regulations. We reserve the right to enact rules for specific pages without updating these Terms. Any such changes will be displayed prominently on the relevant page.

Dispute resolution

In the event of any disputes or complaints, please contact us directly. We will attempt to resolve issues amicably. Any unresolved dispute would be submitted to the tribunals having jurisdiction thereover in the Province of Québec, District of Montréal. 

Third-party services

The Society utilizes third-party services, including ‘Google ReCAPTCHA’ as well as ‘Cloudflare Turnstile’ for security and human verification, ‘Google Maps’ to display maps, ‘Zeffy’ for transaction processing, and ‘MailChimp’ for email communications. We also connect to the website of ‘So German’ (https://sogerman.ca) to provide an event calendar of German-related events in Montréal. We reserve the right to add or remove third-party services and will update this Policy accordingly. Use of our Website constitutes agreement to the terms and conditions of these third-party services. When you sign up to our mailing list, you agree to MailChimp’s terms and conditions. You can unsubscribe from our mailing list at any time by clicking the link in any of our emails. When you are redirected to Zeffy (or another payment processing platform we may use), So German, or Google Maps, or otherwise interact with their platforms through an embedded window on our Website, you will be subject to their terms and conditions, over which we have no control and with regard to which we are not liable in any way.

Intellectual property

Unless otherwise indicated, all content and materials on the Website, including but not limited to text, images, logos, and design elements, are the exclusive property of the German Society or its service providers and are protected by copyright and other intellectual property laws. Unauthorized use of our intellectual property is prohibited.

Disclaimer

While the German Society strives to maintain accurate and up-to-date information on the Website, it makes no warranties or representations regarding the accuracy, completeness, or timeliness of the content.

Changes to Terms

The German Society reserves the right to modify these Terms at any time. Any changes will be posted on this page with an updated revision date. Your continued use of the Website, your registration at Activities, your participation at Activities all constitute, individually and collectively, your acceptance of the revised Terms.
